1. General provisions
1.1. These rules for the purchase/sale of goods (hereinafter - the Rules) are a legal document binding on the Parties, which determine the rights, duties and responsibilities of the Buyer and the Seller when the Buyer purchases goods on SILKIE e. in the store.
1.2. The seller reserves the right to change, amend or supplement these rules at any time, taking into account the requirements established by legal acts. 1.5. 2.7. 2.9. The buyer has the right to demand the correction, destruction of his personal data or the suspension, except for storage, of the processing of his personal data when the data is processed in violation of the provisions of the law.
2.10. The Data Controller recognizes and respects the right to privacy of every Buyer who registers in the SILKIE (www.silkie.lt) online store. The Data Controller collects and uses the Buyer's personal data (name or surname, address, telephone number, e-mail address and other information specified in the online store registration form) for the processing of orders for goods or services or the fulfillment of other assumed contractual obligations. When placing an order or registering, the customer agrees to the rules for buying and selling goods, which 2.3. point states that by approving these rules, the Buyer agrees that the personal data provided by the Buyer will be processed for the purposes of selling goods and services in the SILKIE online store, analyzing the Seller's activities and direct marketing. This also includes the sending of promotional and informational messages, by registering the Buyer agrees to receive newsletters and similar materials, which the Buyer has the full right to refuse.
2.11. The Data Controller undertakes not to disclose the Buyer's personal data to third parties, with the exception of the Data Controller's partners providing goods delivery or other services related to the proper fulfillment of the Buyer's order. In all other cases, the Buyer's personal data may be disclosed to third parties only in accordance with the procedure provided by the legal acts of the Republic of Lithuania.
2.12. Personal data is processed using secure means that protect this data from unauthorized destruction, disclosure or other illegal actions.
2.13. The data of individuals who have agreed to have their data used for direct marketing purposes are stored in an active database and used for 2 years for direct marketing purposes. Buyer data is stored for 2 years from the last purchase. After this term, customer data is (automatically) destroyed. Automatic destruction of personal data is supervised by a responsible person.
3. Buyer's rights and obligations

3.2. 3.7. The buyer, using SILKIE e-mail store, agrees with these purchase and sale Rules and undertakes to comply with them and not to violate the legal acts of the Republic of Lithuania.
4. Seller's rights and obligations
4.1. The seller undertakes to create all conditions for the buyer to properly use SILKIE e-mail. services provided by the store.
4.2. 5. Ordering goods, prices, payment procedure and deadlines.

5.4. The buyer pays for the goods in one of the following ways:

5.4.2. The buyer, who has chosen the services of payment by bank transfer, undertakes to pay for the goods immediately, because only after receiving the payment for the goods, the goods parcel begins to be formed and the deadline for sending the goods begins to be calculated.
5.4.3. The seller issues an electronic version of the invoice to the buyer, a version of the advance invoice, to the specified e-mail address. by mail, received immediately after order confirmation. 6. Delivery of goods

6.3. The buyer, who has chosen the delivery service during the order, undertakes to indicate the exact place of delivery of the goods.
6.4. The buyer undertakes to accept the goods himself. In the event that the Buyer cannot accept the goods himself, and the goods are delivered to the specified address, the Buyer has no right to make claims to the Seller regarding the delivery of the goods to the wrong entity.
6.5. All goods are delivered by UAB OMNIVA, DPD LIEUTUVA service to the address specified in your order information.
6.6. Parcels are delivered to customers within 2-3 working days, delivery may take longer on holidays.
6.7. The seller delivers the goods to the buyer within 7 working days. These terms are preliminary and do not apply in cases where the Seller does not have the necessary goods in stock and the Buyer is informed of the shortage of the ordered goods. At the same time, the Buyer agrees that in exceptional cases the delivery of the goods may be delayed due to unforeseen circumstances beyond the Seller's control. In this case, the Seller undertakes to immediately contact the Buyer and coordinate the terms of delivery of the goods.
6.7.1. The goods in the seller's warehouse are delivered to the buyer on the next working day throughout the territory of Lithuania after the payment of the order. This is valid if the order is placed before 15:00, when the goods are delivered from the warehouse to the courier service. Orders made after this deadline are processed for the next working day. After the goods have been successfully sent, the buyer is informed by an automatic e-mail message. by mail and SMS short messages. Products are delivered next business day only under the following conditions:
6.7.1.1. The order is made before 15:00 on working days and is paid immediately by bank transfer or direct bank transfer to UAB PAYSERA system;
6.7.1.2. The order is made before 3:00 p.m. on working days and the selected method of payment is cash or card to the courier;
6.7.1.3. The ordered goods are in the seller's warehouse, in any other case, the usual rules for the delivery of goods apply;
6.7.2. If the order is placed before 15:00 on working days, but the payment is made later using a bank transfer or the direct payment system of UAB PAYSERA, the dispatch of the order is moved to the next working day, and the deadline for receipt is postponed by two working days.
6.7.3. Any payment made for an order after 3:00 p.m., on business days, or at any time outside of business days, postpones the order's shipping deadline to the next business day.
6.4. When the goods are delivered from warehouses in foreign countries, the delivery may take about 8 - 15 working days.
6.5. If the product is delivered according to an individual order, individually agreed delivery terms apply, but the maximum delivery time does not exceed 3 - 4 weeks. Delivery times for individual products may vary. The preliminary deadline is indicated on the card of each product.
6.6. The ordered goods are always delivered in one shipment, and the Buyer is informed individually about the delivery times of different goods. Ordered several goods can be delivered in separate shipments according to the customer's request for an additional standard delivery fee according to Clause 6 of these rules.
6.7. In all cases, the Seller is released from responsibility for the violation of the deadlines for the delivery of the goods, if the goods are not delivered to the Buyer or are delivered late due to the fault of the Buyer or due to circumstances beyond the Seller's control.
6.8. During the delivery of the goods, you must check the external condition of the package while the courier is present. Upon noticing even the slightest damage to the shipment, it is necessary to write down notes about the damage to the shipment or refuse to accept the shipment.
6.9. After receiving the shipment and signing the manifest without comments, it is considered that the shipment has been delivered in good quality, and in this case, claims for external damage to the goods will no longer be accepted. In any case, the product warranty obligations remain valid.
6.10. In all cases, the Buyer must immediately inform the Seller if the shipment is delivered in damaged packaging, if the shipment contains unordered goods or the wrong amount of them, or if the goods are incomplete.
6.11. In all cases, if the buyer notices any damage to the package during delivery, he must indicate the comments in the package delivery document provided by the courier or draw up a separate document regarding these violations. The Buyer must do this in the presence of the courier. If such actions are not taken, the Seller is exempted from liability against the Buyer for product damage related to packaging damage, which the Buyer did not note in the delivery document of the courier.

6.13. The standard price of goods delivery is not valid when the weight of the goods exceeds 35 kg. When delivering such a product, we will contact you personally.
6.14. When delivering goods to the Curonian Spit, an additional fee of € 3 applies, without exception. When delivering the package to the Curonian Spit, we will contact you personally.
7. Product quality and guarantees, warranty service
7.1. Every SILKIE e-mail the details of the product sold in the store are generally indicated in the product description attached to each product.
7.2. The seller is not responsible for the fact that e-mail the color, shape or other parameters of the goods in the store may not correspond to the real size, shape and color of the goods due to the characteristics of the display used by the Buyer.
7.3. The seller provides a quality guarantee valid for a certain period of time for certain types of goods, the specific term and other conditions of which are indicated in the descriptions of such goods.
7.4. If the seller does not provide a quality guarantee for certain types of goods, the guarantee provided by the relevant legal acts shall apply.
7.5. Directive 1999/44/EC valid throughout the EU provides for a minimum of 24 months. warranty period. In individual cases, the manufacturer may set a shorter or longer term. In this case, the manufacturer's warranty period applies.

7.6.3. Delivery of goods for warranty service is carried out at the buyer's expense.
7.6.3.1. After ordering the warranty service, SILKIE completes all the necessary documents related to the transportation of the product. The customer does not need to fill out anything and additionally print, stick on packages, track. For additional reservations or problems, SILKIE managers contact the customer personally.
7.6.3.2. The courier is called for the next working day after receiving the form. The courier usually informs about the arrival by phone, the customer must prepare and pack the goods before the arrival of the courier.
7.6.4. The buyer undertakes to properly and safely pack the transported goods. SILKIE is not responsible for damage caused during transportation of improperly packed goods returned for warranty service.
7.7. Warranty service is performed by an authorized SILKIE service center, warranty inspection is performed within 5 working days after receipt of warranty goods for repair.
7.8. Warranty repair is carried out up to two weeks (ten working days), but in the event of unforeseen circumstances, when importing the necessary parts from the manufacturer, the warranty repair may last longer, informing the customer about this.
7.8. The manufacturer's warranty does not apply to natural wear parts.
7.9. If the product is found to have a non-warranty defect, caused by the user's fault and/or improper use, the parts required to repair the defect and additional work shall be paid for by the customer. The client is informed about the payment and any work performed for money is carried out only at the request and consent of the client. An invoice is issued for such work, if not paid, the repaired product is not returned to the customer.
7.9.1. If the product is found to have a non-warranty fault, caused by the user's fault and/or improper use, and the buyer refuses to pay for the repair, the cost of returning the goods will be paid by the buyer.
7.10. If the product is found to have a major failure, damage due to a manufacturer's error, a manufacturer's defect or any other quality discrepancy that requires repair by the manufacturer - the product is immediately replaced by a new one for the customer, regardless of how long the product has been used, if the warranty service period is valid.
7.11. The customer always has the right to contact SILKIE and we will try to provide prompt assistance or necessary information regarding product repair. When applying, please indicate the order number, date of purchase, buyer's name, surname or company name.
7.12. If the product is of poor quality, you can return or exchange the product within 14 calendar days from the day of purchase (receipt of the product) in accordance with Chapter 8 of these rules.
8. Return and exchange of goods and/or money
8.1. Defects of the sold goods are removed, low-quality goods are replaced, returned in accordance with the 2001 order of the Minister of Economy of the Republic of Lithuania. 8.2.1. Money is returned to the bank account no later than within 14 working days, this term is calculated from the day the goods are returned to the warehouse.
8.2.2. Return and/or exchange of defective goods is free of charge. Quality goods are returned at the buyer's expense. Returned goods are delivered by a SILKIE chartered courier. The condition of the returned goods is checked by the warranty service, if the returned goods are of good quality, the standard shipping fee in Lithuania ( € 5) is deducted from the returned amount.
8.2.3. After ordering the warranty service, SILKIE completes all the necessary documents related to the transportation of the product. The customer does not need to fill out anything and additionally print, stick on packages, track. For additional reservations or problems, SILKIE managers contact the customer personally.
8.2.4. The courier is called for the next working day after receiving the form. The courier usually informs about the arrival by phone, the customer must prepare and pack the goods before the arrival of the courier.
8.2.5. The buyer undertakes to properly and safely pack the transported goods. SILKIE is not responsible for damage caused during the transportation of improperly packed returned goods.
8.3. When returning goods to the buyer, it is necessary to comply with the following conditions:
8.3.1. The returned item must be in its original, neat packaging;
8.3.2. The product must be undamaged by the Buyer;
8.3.3. The product must be unused, without losing its appearance as a product (label intact, protective film not torn, etc.) (this clause does not apply in the case of returning a defective product);
8.3.4. The returned product must be in the same configuration as the Buyer received it;
8.3.5. When returning the product, it is necessary to present the document of its purchase.
8.4. The Seller has the right not to accept the goods returned by the Buyer if the Buyer does not comply with 8.3. the procedures for returning goods set out in point
8.5. When returning the wrong product and/or low-quality product, the Seller undertakes to take back such products and replace them with similar, suitable products.
8.6. In the event that the Seller does not have goods suitable for replacement, the amount paid will be returned to the Buyer within 14 working days, excluding the cost of delivery.
8.7. SILKIE unilaterally has the right to deduct the amount of the additional discount granted from the amount returned to the customer, if the customer used the additional discount of the offer and later canceled (returned) at least one quality product from the offer to which the discount was applied.
8.8. In the event that the reason for returning the product is inadequate quality, SILKIE undertakes to replace the product of inadequate quality with a product of adequate quality at its own expense or to return the money paid for the product. Goods of inappropriate quality are exchanged or returned in accordance with the "Rules for returning and exchanging goods", approved by Order No. 217 of the Minister of Economy of June 29, 2001.
8.9. If, during the warranty period, a product of inadequate quality purchased by the customer is replaced by a new product of adequate quality, the remaining warranty period applies to the replaced product, i.e. the warranty period is not extended.
8.10. IMPORTANT! The procedure for returning goods does not apply to: Legal entities, products with individual changes by the customer, according to wishes, individual orders (for example, printing) that damage their original merchandise appearance irreplaceably, individually ordered goods, goods that have been damaged by the customer, goods that do not meet the above-mentioned return standards (damaged merchandise appearance) , with signs of use, wear and tear), for goods to be returned after the 14-day return period, an exception applies to goods that do not meet the return requirements, but of poor quality.
9. Liability of buyer and seller
9.1. The Buyer is fully responsible for the correctness of the personal data provided by the Buyer. If the Buyer does not provide accurate personal data in the registration form, the Seller is not responsible for the resulting consequences and acquires the right to demand compensation from the Buyer for direct losses incurred.
9.2. The buyer is responsible for actions performed using SILKIE e-mail. in the store.
9.3. After registering, the Buyer is responsible for transferring his login data to third parties. If SILKIE email the services provided by the store are used by a third person who is connected to this e-mail. store using the Buyer's login data, the Seller considers this person as the Buyer.
9.4. The Seller is released from any responsibility in cases where losses arise because the Buyer, regardless of the Seller's recommendations and the Buyer's obligations, did not familiarize himself with these Rules, although he was given such an opportunity.
9.5. 9.6. In the event of damage, the guilty Party compensates the other Party for direct losses.
10. Marketing and Information

10.2. The seller has the right unilaterally, without separate notice, to change the conditions of the shares, as well as to cancel them. Any change or cancellation of the terms and conditions of the promotion is valid only going forward, that is, from the moment of their execution.
10.3. The Seller sends all messages using the means of communication specified in the Buyer's registration form.
10.4. The Buyer sends all messages and questions to the Seller's e-mail. by phone or e-mail specified in the "Contacts" section of the store. email addresses.
10.5. The seller is not responsible if the buyer does not receive the sent informational or confirming messages due to disruptions in the internet connection, e-mail service providers' networks.
11. Final Provisions
11.1. These Rules for the purchase/sale of goods are drawn up in accordance with the laws and regulations of the Republic of Lithuania.
11.2. All disagreements arising from the implementation of these Rules shall be resolved through negotiations. If an agreement cannot be reached, disputes are resolved in accordance with the procedure established by the laws of the Republic of Lithuania.
